Terms of Service

Your responsibilities in using Sigap AI

By using the Sigap AI website or product ("Services"), including but not limited to creating AI agents ("Content"), you are agreeing to be bound by the following terms and conditions ("Terms of Service"). If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity, its affiliates and all users who access our services through your account to these terms and conditions, in which case the terms "you" or "your" shall refer to such entity, its affiliates and users associated with it. If you do not have such authority, or if you do not agree with these terms and conditions, you must not accept this agreement and may not use the services.

Sigap AI reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Services, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Services after any such changes shall constitute your consent to such changes. Violation of any of the terms below will result in the termination of your Account. While Sigap AI prohibits such conduct and Content on the Services, you understand and agree that Sigap AI cannot be responsible for the Content posted on the Services and you nonetheless may be exposed to such materials. You agree to use the Service at your own risk.

Account terms

  1. You must be 16 years or older to use the Services.
  2. You must provide a valid email address in order to complete the signup process.
  3. You are responsible for maintaining the security of your account and password. Sigap AI cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  4. You are responsible for all Content posted and activity that occurs under your account (even when Content is posted by others who have accounts under your account).
  5. You may not use the Services for any illegal or unauthorized purpose. You must not, in the use of the Services, violate any laws in your jurisdiction (including but not limited to copyright or trademark laws).

AI Agent terms

  1. You own the AI agents you create and can use them however you want within the terms of service.
  2. You are responsible for the content and behavior of your AI agents, including ensuring they comply with applicable laws and regulations.
  3. You are solely responsible for assessing whether Sigap AI and the AI agents are appropriate for your needs.
  4. You assume all risks associated with using the AI agents and their responses.
  5. You must not create AI agents that promote harmful, illegal, or inappropriate content, or that impersonate real individuals without consent.

WhatsApp Integration

When integrating your AI agents with WhatsApp, you agree to comply with WhatsApp's Terms of Service and API policies. You are responsible for ensuring your use of WhatsApp through our platform complies with all applicable laws and regulations.

You acknowledge that WhatsApp integration requires a paid subscription plan. Free accounts can create and test AI agents but cannot integrate with WhatsApp.

Payment and Billing

Sigap AI offers a free tier for creating and testing AI agents. Paid plans are required for WhatsApp Business integration and are based on monthly AI message response limits.

Message limits are soft limits, meaning your agent will continue to work even if you exceed the monthly limit. We will notify you when you are approaching or exceeding your limit, and you can upgrade your plan or purchase additional message credits as needed.

You can cancel your subscription at any time through your account settings or contact [email protected]. Cancellation does not result in a refund for the current billing cycle, but it ensures you will not be automatically billed for the next cycle.

You will receive an email reminder 7 days before your subscription renews. If you do not cancel your subscription before the renewal, you will be charged the price for the subscription renewal.

Communications

By creating an Account on our Services, you agree to subscribe to newsletters, marketing, or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by using the unsubscribe link at the bottom of our emails or emailing [email protected].

Data and Privacy

Your use of our Services is also governed by our Privacy Policy. You agree that we may process your data as described in our Privacy Policy, including for the purpose of improving our AI technology and providing better service.

When you integrate with WhatsApp, you acknowledge that conversation data may be processed by both Sigap AI and WhatsApp in accordance with their respective privacy policies.

Limitation of liability

Except as prohibited by law, you will hold us and our officers, directors, employees, and agents harmless for any indirect, punitive, special, incidental, or consequential damage, however it arises (including attorneys' fees and all related costs and expenses of litigation and arbitration, or at trial or on appeal, if any, whether or not litigation or arbitration is instituted), whether in an action of contract, negligence, or other tortious action, or arising out of or in connection with this agreement, including without limitation any claim for personal injury or property damage, arising from this agreement and any violation by you of any federal, state or local laws, statutes, rules, or regulations, even if Company has been previously advised of the possibility of such damage. Except as prohibited by law, if there is liability found on the part of the Company, it will be limited to the amount paid for the products and/or services, and under no circumstances will there be consequential or punitive damages. Some states do not allow the exclusion or limitation of punitive, incidental or consequential damages, so the prior limitation or exclusion may not apply to you.

Termination

We may terminate or suspend your account and bar access to Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of Terms. If you wish to terminate your account, you may simply discontinue using the Services. All provisions of Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Changes to Services

We reserve the right to withdraw or amend our Services, and any service or material we provide via Services, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Services is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Services, or the entire Services, to users.

Acknowledgment

By using Services provided by us, you acknowledge that you have read these Terms of Service and agree to be bound by them.
